Frequently Asked Questions
This is general information, not legal advice. For anything unusual or high-stakes, check with a practising advocate.
Is the affidavit generated here legally valid on its own?
The PDF you download is a correctly formatted draft. To be legally valid for most purposes in India, it must be printed on the applicable non-judicial stamp paper and signed before a Notary Public, Oath Commissioner, or Executive Magistrate.
Which affidavit type should I choose?
Choose based on the purpose stated by the authority requesting the document — for example, banks typically ask for an address proof affidavit, while passport or visa applications after marriage often require a marriage affidavit.
Can advocates use this for multiple clients?
Yes. Advocates can create an account and generate affidavits for different clients by entering each client's details individually.
Is my personal information stored?
Details you submit are used only to generate your PDF and, if you create an account, to manage your sign-in. See our support team for any data questions.
What exactly is a Notary Public, and why does my affidavit need one?
A Notary Public is an official authorised by the state government to witness signatures and certify that a document was signed by the person it claims to be signed by. For most affidavits to be accepted by a bank, government office, or court, the deponent must sign in the notary's presence, and the notary then stamps and signs the document to confirm this happened. Without that attestation, an affidavit is generally treated as an unverified private statement rather than a document the receiving authority can rely on.
Can I use stamp paper bought in one state for an affidavit executed in another?
There's no blanket rule in the Indian Stamp Act against it, and stamp paper purchased in one state can generally be used in another, as long as the stamp duty paid matches or exceeds what your state requires for that type of document. Because practice varies and some receiving offices are stricter than others, it's worth checking with the specific bank, court, or authority that will accept your affidavit before relying on out-of-state stamp paper for anything time-sensitive.
Who is legally allowed to execute (sign) an affidavit?
Generally, any adult who is of sound mind can execute an affidavit for themselves. A parent or legal guardian can execute one on behalf of a minor or a dependent who can't sign for themselves, and an authorised representative — a director, partner, or power-of-attorney holder — can execute one on behalf of a company, firm, or another individual where the law or a document permits it.
What happens if information in my affidavit turns out to be false?
An affidavit is a sworn statement, so knowingly making a false statement in one is a punishable offence under Indian law, separate from any consequences with the authority you submitted it to (such as rejection of your application or cancellation of a benefit already granted). Always fill in details you can stand behind, and if a fact is uncertain, don't guess — get it right before you sign.
